1. Application & Agreement
1.2 Netbela only provides products to customers who agree to these terms and conditions.
1.3 These terms and conditions are governed by Dutch law.
1.4 Netbela reserves the right to amend these terms and conditions at any time without prior notice.
1.5 The agreement becomes effective upon the dispatch of the order confirmation email.
1.6 If any part of the agreement is found to be legally invalid, the remainder of the agreement remains unaffected.
1.7 Customers must provide truthful information during registration; payment information must be accurate and belong to the registering individual, unless it pertains to someone under the customer's custody or guardianship.
1.8 Netbela will only send marketing emails with an unsubscribe option and with prior permission from the customer; unsolicited messages will not be sent.
2. Delivery & Obligations
2.1 Netbela aims to deliver products within 24 hours unless otherwise stated in the product description.
2.2 Products are delivered only if the corresponding invoice is paid.
2.3 Netbela guarantees that the products meet the specifications and conditions stated in the offer.
3. Payments & Invoicing
3.1 Payments are to be made within the terms indicated on the invoice unless otherwise agreed.
3.2 Services may not be activated automatically after payment verification.
3.3 Services will be automatically suspended if the payment is overdue.
3.4 The right of withdrawal begins upon activation of the service and lasts for 14 days.
3.5 The right of withdrawal is only valid if the procedure is conducted via the communication methods stated in Article 10 paragraph 1, excluding methods 2, 3, and 5.
3.6 The right of withdrawal is only valid if the procedure is through Netbela and not third parties.
3.7 The right of withdrawal does not apply to custom services such as custom dedicated servers and VPS products.
3.8 The right of withdrawal is not valid for business customers.
3.9 Netbela reserves the right to delete customer data and servers if monthly recurring payments are not made.
4. Intellectual Property
4.1 Images, illustrations, texts, videos, etc. on Netbela platforms are indicative and cannot be used as a basis for termination of an agreement or refund.
4.2 Copyright applies to all images, illustrations, texts, videos, and other visual aspects on Netbela platforms.
5. Liability
5.1 Netbela is not liable for damages resulting from service interruptions or maintenance.
5.2 The maximum liability will not exceed the value of the service provided.
6. Force Majeure
6.1 Force majeure includes errors from Netbela suppliers, interruptions, malfunctions, attacks, fire, water damage, internal issues, licensing problems, DDoS attacks, and third-party business operation issues.
6.2 If a force majeure situation lasts longer than 30 days and still affects the service, either party may terminate the agreement. Reimbursement is not applicable.
7. Technical
7.1 Netbela's servers are located in various data centers, including but not limited to: Equinix AM5 Amsterdam.
7.2 Netbela performs irregular backups and is not obligated to provide regular backups or restore data.
7.3 Maintenance work may occur without prior notice. Interruptions due to maintenance are not considered downtime unless agreed upon in our SLA.
7.4 In cases of excessive use of a service, Netbela is authorized to suspend the service or issue an additional invoice for the incurred costs.
8. Pricing
8.1 All prices indicated on Netbela's internet site or communication platforms are indicative and subject to printing, typesetting, and spelling errors. The indicated price does not affect the validity of the agreement.
8.2 Price adjustments by Netbela for a product or service will be applied to the next invoice.
8.3 All prices on Netbela's website exclude VAT for customers outside The Netherlands.
8.4 All prices on Netbela's website are in Euros.
8.5 Netbela is authorized to adjust prices with a minimum 14-day advance notice to the customer.
9. Use
9.1 It is prohibited to use Netbela's services for activities that contravene Dutch law, including but not limited to DDoS attacks, spreading defamatory messages, racism, and hate speech.
9.2 Netbela reserves the right to implement necessary measures to mitigate or prevent risks if there is potential for disruption, harm, or any threat to the integrity of our services or that of third parties, particularly due to activities such as hacking, denial of service attacks, or exploitation of software vulnerabilities.
9.3 Netbela may recover damages resulting from violations of these terms. Customers indemnify Netbela from all third-party claims related to damage resulting from such violations.

11. Definitions
11.1 “Customer” refers to the purchasing party, the person or legal entity who purchases a service from Netbela.
11.2 "Netbela" refers to the business entity registered under the trade name "Netbela" with Chamber of Commerce number 75410982, located at Hoornblad 67, 7772MJ Hardenberg, The Netherlands
